VOLKSWAGEN EMISSIONS CLASS ACTION: Rosen Law Firm Announces Investigation of Class Action Claims on Behalf of Owners of Certain Volkswagen and Audi Vehicles

New York, NY, September 21, 2015.  The Rosen Law Firm announces that it is preparing a class action lawsuit against Volkswagen Group of America, Inc. (“Volkswagen”) alleging that Volkswagen misrepresented to consumers that certain of its vehicles met air pollution standards set forth by the United States Environmental Protection Agency (“EPA”) when, in fact, the vehicles did not. 

According to the notice of violation issued by the EPA, Volkswagen knew that the vehicles failed to meet EPA pollution standards and actively concealed this information from consumers and regulators.  In order to carry out its scheme of deception, Volkswagen installed a sophisticated software algorithm in the cars that turned on pollution controls only when the car was being tested to determine if it met standards.  When not being tested, the software turned off emission reducing functions.  Thus, during routine operation and driving, these vehicles emitted up to 40 times more pollution than the standards permitted, and are unfit to be registered for use in the United States.  The EPA expects to compel Volkwagen to recall all of the vehicles in the future, but owners are advised that the cars are still safe and legal to drive. 

The affected vehicles are:

  • Jetta (MY 2009 – 2015)
  • Beetle (MY 2009 – 2015)
  • Audi A3 (MY 2009 – 2015)
  • Golf (MY 2009 – 2015)
  • Passat (MY 2014-2015)
