The Rosen Law Firm Announces Jimmy John’s Data Breach Class Action Update – Are You a Non-Arizona Citizen That Made a Purchase between July 30, 2014 and September 24, 2014?

New York, N.Y., August 7, 2015.  If you made a purchase at a Jimmy John’s restaurant using your credit or debit card between July 30, 2014 and September 24, 2014, you may wish to participate in a class action lawsuit against the national sandwich chain Jimmy John’s Gourmet Sandwiches.  The Rosen Law Firm, P.A. previously filed a class action lawsuit against Jimmy John’s in connection with a security breach that resulted in customers’ credit and debit card information being stolen by third parties.  The Rosen Law Firm, P.A. recently filed an amended complaint in the action and is optimistic about the prospects of the case after the United States Court of Appeals for the Seventh Circuit issued a favorable decision to consumers seeking remedies in connection with the theft of their personal and financial information.

However, if you live in a state other than Arizona, you may end up not receiving any recovery from the current class action against Jimmy John’s because the current class action contains only a plaintiff from Arizona.  The courts typically limit recovery only to those who reside in states in which there is a named plaintiff.  To ensure that you are eligible to receive any recovery, should the action be successful, you may seek to become a plaintiff in the class action.  This will also enhance the likelihood that all other affected consumers from the state in which you live are able to participate in any recovery.

The Complaint alleges that Jimmy John’s grossly inadequate information systems and network security oversight led to an ongoing pilfering of customer credit and debit cards by third party criminals.  The Complaint further asserts that despite its awareness of the security intrusion and data theft on July 30, 2014, Jimmy John’s remained unlawfully silent for nearly two months until it disclosed the data breach on September 24, 2014.
