The Rosen Law firm has filed a class action lawsuit charging Kohlberg Capital Corporation with violating the federal securities laws for misstating the value of its loan portfolio in its financial statements.
On December 15, 2009 Kohlberg Capital Corporation announced that its financial statements for the fiscal year ended December 31, 2008 and the first two quarters of 2009 should no longer be relied upon, as a result of potentially improper valuation of its loan portfolio. Kohlberg's auditprs have stated that Kohlberg has not provided requested information to support the valuation of the loan portfolio and that the information on which the valuations were based was incomplete and inaccurate. Kohlberg has admitted that the true fair value of the Company’s loan portfolio investments is materially less than as reported on its prior financial statements.
This adverse news has caused the price of the Company's stock to drop, damaging investors. The class action lawsuit seeks to recover losses for KCAP investors.
